Safety Data Sheets are the most relevant document concerning the transmission of information on substances and mixtures, since they hold relevant information concerning physical and chemical properties, data concerning toxicity, and information on environmental hazards. All this info is relevant for a correct and safe use of the chemical product.

When to provide the SDS

The SDS (Safety Data Sheet) must be provided for free, on paper or in electronic form (annex, mail, CD, HDD, etc.) no later than the date of provision of the substance or mixture.

What the law says

  • Article 31 of REACH, paragraphs 1 and 3, describes the obligation for each supplier of substances or mixtures to transmit an SDS to each substance or mixture recipient, in accordance with REACH Annex II. Concerning this, ECHA clarifies that giving the possibility to download the SDS from a website is not enough to fulfil the need to provide the SDS to recipients (ECHA guideline of September 2011).
  • Article 36 of REACH, paragraph 1, specifies that "Each manufacturer, importer, downstream user and distributor shall assemble and keep available all the information he requires to carry out his duties under this Regulation for a period of at least 10 years after he last manufactured, imported, supplied or used the substance or mixture.".

What does this mean?

In addition to classifying the hazardousness of chemical products and then preparing the related SDS and ES, it is important to manage document storage and their communication.
