Proposal to amend Regulation (EU) 2024/2865 to postpone the application of labelling obligations under the CLP Regulation

Regulation (EU) 2024/2865

On 20 November 2024, Regulation (EU) 2024/2865 of the European Parliament and of the Council was published, amending Regulation 1272/2008 (CLP) on classification, labelling and packaging of substances and mixtures. In particular, it adds Chapter 3 to Title III of the CLP, updating the labelling formats.

New proposal: what and when?

The current proposal aims to simplify and make more flexible the formatting rules established for the labelling of hazardous chemicals.

In particular, it postpones until 1 January 2028 the deadlines for the mandatory application of various labelling requirements under Regulation (EU) 2024/2865, including mandatory formatting, advertising rules, distance sales, label updates within six months and fuel pump labelling. This postponement is designed to provide legal certainty for businesses and avoid different application dates for similar obligations arising from two amending acts of the CLP Regulation.

The main changes concern:

  • rules on mandatory minimum font size and line spacing
  • removing the fixed six-month deadline for updating the label, instead maintaining the more flexible requirement to ensure that the label is updated without undue delay
  • expand the use of digital labelling, allowing more information to be provided on the digital label only
