The U.S. FDA Allows Extension of Enforcement Discretion Period for Nutrition Facts Label Requirements

The United States Food ad Drug Administration (FDA) has announced to extend six months of enforcement discretion for Nutrition Facts Panel compliance after the January 1, 2020.
In May 2016, the FDA has published the well-known final rules on nutritional labelling and serving size regulatory changes. In May 2018, the enter into force date had already been extended according to the business size of food manufacturers:
- January 1, 2020 for manufacturers with $10 million or more in annual food sales
- January 1, 2021 for manufacturers with less than $10 million in annual food sales
Now, due to the recent request of manufacturers to postpone the compliance date, the FDA has enforced the deadline to January 1, 2020; however, a six-months period of tolerance against prosecution actions will be considered.
